Terms of Service

1. Acceptance

By creating an account or using Estato, you agree to these Terms of Service. Estato is operated by Adrian Sutherland, Ontario, Canada. If you do not agree to these terms, do not use the service. For questions, contact adrian@myestato.com.

2. Subscription and Trial

Estato offers a 14-day free trial. A valid payment method is required to start your trial. You will not be charged until the trial ends. Current plans are:

• Solo — $99/month or $948/year (CAD)
• Team — $199/month or $1,908/year (CAD)

Prices are in Canadian dollars and are subject to change with at least 30 days notice to active subscribers.

3. Cancellation

You may cancel your subscription at any time from the Billing page in your Estato account. Your access will continue through the end of the current billing period. No refunds are issued for partial billing periods.

4. Acceptable Use

Estato is designed for licensed real estate agents operating in Canada. You agree not to:

• Scrape, copy, or reverse-engineer the service
• Share your account credentials with others
• Use the service for any unlawful purpose
• Abuse automated features (email campaigns, bulk sends) in violation of anti-spam laws

5. Your Data and Client Consent

You are responsible for obtaining any required consent from your clients to store their personal information in Estato. Estato stores and processes client data on your behalf as your agent for that data. You remain the data controller for client information you enter into the platform.

6. No Legal or Financial Advice

Estato is a productivity tool for real estate professionals. Nothing in the platform, its features, or any output from Estato constitutes legal, financial, tax, or compliance advice. Consult qualified professionals for those matters.

7. FINTRAC

The FINTRAC tracking feature within Estato is a reminder and organizational tool to help you stay on top of your record-keeping. It is not a compliance service and does not guarantee regulatory compliance. Estato does not verify the accuracy or completeness of compliance records. Consult your brokerage's compliance officer and FINTRAC guidelines for your obligations.

8. Email and Calendar Integration

By connecting your Gmail account, you authorize Estato to send emails on your behalf using the gmail.send scope. Estato does not read your inbox. Forwarded emails from clients are stored in Estato to provide email history on client records.

By connecting Google Calendar, you authorize Estato to read and write calendar events on your behalf for the purpose of syncing showings and closings.

9. Service Availability

Estato aims to provide reliable, high-availability service. We do not guarantee uninterrupted access. Scheduled maintenance will be communicated with reasonable notice when possible.

10. Limitation of Liability

To the extent permitted by applicable law, Estato's total liability for any claim arising out of or relating to this service is limited to the amounts you paid in the three months preceding the claim. Estato is not liable for indirect, incidental, special, consequential, or punitive damages.

11. Termination

You may cancel your account at any time. We may suspend or terminate accounts that violate these terms, engage in illegal activity, or abuse the platform. Upon termination, your data will be retained for a reasonable period before deletion, consistent with our Privacy Policy.

12. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts of Ontario, Canada.

13. Changes to These Terms

We will notify active subscribers by email at least 14 days before making material changes to these terms. Continued use of Estato after changes take effect constitutes acceptance of the updated terms.
